Court allows Steram to consider amending suit against EC


The High Court in Kuala Lumpur has given PKR candidate for Rantau, Dr S Streram, time to consider amending his civil suit pending the Seremban Election Court's decision on Nov 22.
This was revealed during case management before Judicial Commissioner Daryl Goon today.
Irzan Iswat, the lawyer for Streram, said following that, Goon fixed Jan 4 for case management for all amendments to be done and for the defendants, namely returning officer Amino Agus Suyub and the Election Commission, to file their defence.
The court has also fixed Aug 1, 2,8 and 9, next year, for trial.
Last September, it was reported that Goon dismissed the striking-out application by Amino and the EC, and ordered the civil suit to proceed to trial.
Streram had on May 7, filed an RM7.6 million misfeasance in public office suit, against Amino and the EC's actions which resulted in him being unable to contest the 14th general election.
In his statement of claim, Streram alleged that the defendants failed in their responsibilities under the Election Commission Act 1958, which resulted in him not being able to contest the state seat after obtaining an appointment letter from his party.
As a result, he added, former Negeri Sembilan menteri besar Mohamad Hassan had won the Rantau seat uncontested.
He said the EC's failure to accept his nomination has violated his constitutional rights.
Streram is seeking RM5 million in general damages, RM2.6 million in exemplary damages, and other relief deemed fit by the court.
Last month, Amino was sentenced by the Election Court to three months jail for contempt of court, for allegedly trying to guide a witness to testify. - Mkini
