M Reza Hassan, the lawyer who appeared for Port Dickson voter Noraziah Mohd Shariff, who is challenging the pardon granted to its new MP Anwar Ibrahim, today discharged himself from representing her.
Reza claimed that the reason to remove himself from representing Noraziah was because he could not get instructions from her.
The lawyer informed this to High Court judge Azizah Nawawi during the case management in Kuala Lumpur. The judge allowed the application.
However, Justice Azizah told Reza to file an affidavit today on his move, through his firm M/s Raja Riza & Associates.
The judge also maintained next Monday, Nov 8, as the hearing date for the applications from Anwar and the Attorney-General’s Chambers to strike out the suit.
Reza appeared for Noraziah while J Leela appeared for Anwar.
The AG’s Chambers is objecting to the application on the grounds that Noraziah should have filed it in the Election Court and not in the High Court.
Noraziah, 38, filed the suit on Sept 28 to invalidate the pardon granted to Anwar.
Her originating summons sought the court's declaration that the royal pardon does not invalidate Anwar's disqualification from holding public office.
Noraziah also sought declarations that the Pardons Board was not established constitutionally, the royal pardon was not in accordance with Article 42(5) of the Federal Constitution and that Anwar was not allowed to run for public office until the expiry of the five-year ban imposed upon his conviction and jailing for Sodomy II.
In her affidavit in support of the application, Noraziah argued that the royal pardon was defective on grounds that the Federal Territories Pardons Board advised the Yang di-Pertuan Agong in an unconstitutional manner.
Anwar, who is also the incoming PKR president, won the Oct 13 Port Dickson by-election with a majority of 23,560 votes. - Mkini
